			<content:encoded><![CDATA[<p>Importers affected by Countervailing Duties (CVD) on aluminum extrusions from China will be glad to hear that, on April 4th, 2012, the Court of International Trade ordered the Department of Commerce to reconsider the “all others” CVD rate of 374.15%.</p>
<p>The Court had issues with Commerce’s methodology for determining the rate as well as the fact that rate appears to be punitive rather than remedial. CVD rates are supposed to remedy the unfair market advantage obtained by a seller overseas when a foreign government subsidizes an industry.</p>

<p>This rigorous program of study is the highest level of professional certification for International Traffic in Arms Regulations (ITAR). <span id="more-913"></span>Participants must complete a demanding 36-week course on all aspects of ITAR, including documentation, compliance ethics, ITAR exemptions, auditing, Technology Control Plans, and many other requirements.</p>

<p>Finding out that the government wants to do an end-use check on your export is a lot like finding out that you’re being audited by the IRS. Anxiety begins to take over. You may ask yourself, what did I do wrong? The reality of the situation is that you may have been selected at random, so don’t panic. Through the U.S. Bureau of Industry and Security—the agency that performs these checks—the government is attempting to verify that your exported goods are not being used by the wrong people or for the wrong reasons. Ultimately, end use checks are a proactive way to protect national security. <p>Many of our clients produce molds as part of their manufacturing process.<span id="more-675"></span></p>
<h3>Did you know?</h3>
<p>US Customs requires that importers not only pay duty on the physical product, but also pay duty on &#8220;assists&#8221; that aided in the production of that product.</p>
<h3>According to US Customs, these listed assists should be reported as part of the import value of your products.</h3>
<ol>
<li>Tools, dies, molds, and similar items used in producing the imported merchandise.</li>
<li>Materials, components, parts, and similar items incorporated into the product.</li>
<li>Merchandise consumed in producing the imported merchandise.</li>
<li>Engineering, development, artwork, design work, plans and sketches that are  undertaken outside the United States.</li>
</ol>
<p><em><strong>Remember:</strong> </em>The lump sum value of any assist is considered part of the transaction value of the merchandise. First, the value of the assist is determined; then the value should be declared on the first shipment or alternatively prorated to the unit cost of the imported merchandise.</p>
<p>Stay compliant and avoid unnecessary fines!</p>

“Chuck Miller brings over 25 years of international business, technical, operational, and supply management experience to MGTA,” said Mohawk’s President and CEO Gar Grannell.</p>
<p>Prior to joining MGTA, Miller held a number of executive positions in engineering and supply management with United Technologies Corporation. For the past nine years, his supply chain management consulting practice has provided support to U.S. and international companies in the areas of strategic sourcing, supply management, as well as supplier quality and risk management. He has managed strategic sourcing projects across a broad range of commodity categories with suppliers in China, Russia, Europe, Latin America, and the U.S.</p>

			<content:encoded><![CDATA[<p>On January 1, the European Union will begin enforcing new data filing requirements that could have wide reaching effects on U.S. exporters shipping to the EU.</p>
<p><span id="more-405"></span>Similar to the U.S. Customs Importer Security Filing/10+2 rule, the EU’s new regulations require shipment data to be filed with Customs before inbound goods arrive in the EU. Sending this information beforehand allows EU Customs officials to manage risk screening more effectively.</p>
<p>Unlike the American rule, which puts the filing burden on importers, the EU rule holds the transportation carrier responsible for filing. Carriers will be required to collect and electronically submit shipment details to EU Customs via an Electronic Summary Declaration. The Declaration will include cargo identification details; information about the consignee, carrier, filer; and routing information.</p>
<p>Another difference between the U.S. and EU regulations is the scope of affected cargo. Unlike the U.S. rule, which applies to maritime shipments only, the EU rule applies to maritime, air, rail/inland waterways, and road traffic.</p>
<h3>Impact on U.S. exporters and shippers</h3>
<p>Since carriers are responsible for filing, U.S. exporters who ship to the EU will most likely be charged processing fees to help offset the costs associated with transmitting the Entry Summary Declaration.</p>
<p>U.S. exporters may also experience shipment delays during the implementation period at the beginning of the year. To avoid disruption to their supply chains, exporters may want to consider temporarily upping stock levels before January 1.</p>

			<content:encoded><![CDATA[<p>U.S. exporters that rely on a forwarder to submit their Automated Export System (AES) filings can now obtain a year’s worth of filing records for free.</p>
<p><span id="more-402"></span>The U.S. Census Bureau will now provide exporters with 12 months of AES filing records each year, free of charge. For data beyond 12 months, Census charges a fee of $125 per month requested. Requests will only be granted for the exporter/U.S. Principal Party in Interest (USPPI) or their authorized agent. Agents must have a power of attorney (referred to as a certificate of authority) from the exporter if making the request on their behalf.</p>
<h3>Why request your AES data?</h3>
<p><strong>1. You want to independently verify what your forwarder is filing on your behalf.</strong><br />
Don’t rely on your forwarder to confirm what they’ve filed for you. Obtain the records directly from Census and have the advantage of seeing exactly what Census is seeing.</p>
<p><strong>2. Save time if you use multiple export forwarders.</strong><br />
It can be very time consuming to try to keep track of which forwarders submitted which filings if you use more than one forwarder throughout the year. Exporters who request AES data from Census will receive all records of filings made on their behalf, regardless of who submitted the filing.</p>
<h3>How to request your AES data</h3>
<p>1. Submit your request in writing and printed on your company’s letterhead.</p>
